Terms of Service

By downloading, installing, or using the Anota Health iOS application ("Anota", "the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Mogambo ("we", "us", or "our"), the developer of Anota Health.

Anota is intended solely for use by licensed medical professionals, including physicians, nurses, dentists, and other qualified healthcare practitioners. By using the App, you represent and warrant that:

• You are a licensed healthcare professional in your jurisdiction
• You are at least 18 years of age
• Your use of the App complies with all applicable laws and professional regulations
• You have the authority to enter into these Terms

Anota is an AI-powered clinical documentation assistant that records consultation audio, generates transcriptions, and produces structured clinical notes (including SOAP-format summaries) to support medical documentation workflows.

Anota is a documentation assistance tool only. It does not provide medical advice, diagnosis, or treatment recommendations. All clinical decisions remain solely the responsibility of the licensed healthcare professional using the App.

• Clinical judgment. AI-generated notes are drafts only. You must review, verify, and edit all output before incorporating it into any official medical record or clinical workflow.
• Not a medical device. Anota is a productivity and documentation tool. It has not been reviewed or approved by the FDA, Health Canada, or any other medical device regulatory authority.
• Accuracy. Transcription and note generation may contain errors. We make no warranty regarding the accuracy, completeness, or fitness for any clinical purpose of the generated output.
• Patient consent. You are solely responsible for obtaining any required consent from patients before recording consultations, in accordance with the laws of your jurisdiction.
• No patient identifiers. You must not enter patient names, national ID numbers, or other directly identifying information into the App.

You agree not to:

• Use the App for any unlawful purpose or in violation of applicable regulations
• Record consultations without appropriate patient consent
• Attempt to reverse engineer, decompile, or extract the App's source code
• Use the App to store or transmit directly identifying patient information
• Share your account credentials with any other person
• Attempt to circumvent subscription gates or in-app purchase requirements
• Use automated scripts or bots to interact with the Service
• Interfere with or disrupt the security or integrity of the Service

All content, features, and functionality of the App — including but not limited to text, graphics, logos, software, and AI models — are the exclusive property of Mogambo and are protected by applicable intellectual property laws.

Clinical notes and documentation generated by Anota during your consultations belong to you. We do not claim ownership over content you create using the Service.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

To the fullest extent permitted by applicable law, Mogambo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from:

• Errors or inaccuracies in AI-generated clinical notes
• Reliance on App output for clinical decisions
• Loss of data or service interruptions
• Unauthorized access to your account

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the App and delete your account at any time from Settings → Delete Account.

Upon termination, your right to use the App ceases immediately. Sections 5, 7, 9, 10, 12, and 13 survive termination.

These Terms are governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Mexico City, Mexico.

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or sending an email to your registered address. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
